1. Purpose and Scope

These Terms & Conditions govern the contractual relationship between OrchestraPlay and any individual or entity making a purchase or subscribing on the website. Placing an order on the website implies full and unconditional acceptance of these terms.

2. Products and Services Offered

OrchestraPlay offers digital audio files for purchase and subscription, referred to as "orchestral accompaniments," allowing musicians to practice or perform with a realistic orchestral accompaniment. Files are securely hosted and streamed via the Kinescope platform.

3. Subscriptions

Access to content requires a paid subscription, with no fixed-term commitment. The subscription renews automatically each month unless cancelled by the user. Payment is processed by credit card via Stripe.

4. Intellectual Property

All content on the OrchestraPlay website is protected by copyright. Users are granted a personal, non-exclusive right to listen within the private context of their subscription.

Premium subscriptions may include an optional in-browser recording feature, allowing subscribers to record their own performance using their device's microphone for personal practice purposes. Any recording made through this feature — including any portion of OrchestraPlay's orchestral accompaniment captured incidentally as ambient sound — remains the exclusive property of OrchestraPlay. Such recordings are intended strictly for the subscriber's personal, non-commercial use and may not be reproduced, redistributed, published, or shared publicly in any form.

5. Pricing and Payments

Prices are listed in US dollars (USD), all taxes included. OrchestraPlay reserves the right to modify its pricing at any time.

6. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied immediately after payment.

8. Governing Law
